Terms of Service
The terms that govern your use of CareChain. This is a draft for review and not legal advice; it must be reviewed by counsel before launch.

1. Acceptance of terms
By using CareChain, whether as a patient, an allied health provider, a referring physician, a partner, or a visitor, you agree to these terms. If you are using CareChain on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms. If you do not agree, please do not use the service.
2. The service
CareChain is a marketplace that connects patients with allied health providers for specialty assessment and triage, and coordinates referrals, records, scheduling, and payments across that network. CareChain coordinates care but does not itself provide a medical diagnosis outside of a booked assessment, and it is not a substitute for the clinical judgement of a treating provider.
3. Not for emergencies
CareChain is not an emergency service. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not use CareChain to request urgent or emergency care, and do not rely on it for time-critical clinical decisions.
4. Accounts
Some features require an account. When you hold an account, you agree to:
- keep your login credentials confidential and not share them;
- provide accurate, current information and keep it up to date;
- accept that we may suspend or close an account that breaches these terms or is used to compromise the safety of the service.
You are responsible for activity that occurs under your account.
5. Acceptable use
You agree not to misuse the service. You will not attempt to access data you are not authorised to see, interfere with the operation or security of the platform, upload unlawful or harmful content, or use CareChain to provide care you are not qualified or licensed to provide. We may remove content or restrict access to protect patients, providers, or the integrity of the service.
6. Providers and partners
Allied health providers, clinics, and health-system partners agree to the additional obligations set out in their onboarding agreement, including maintaining valid registration and licensure, following CareChain's clinical and triage protocols, and meeting the documentation and audit requirements that allow outcomes to be measured. Providers remain responsible for the care they deliver.
7. Payments and fees
Where a service carries a fee, the amount is shown before you confirm. Patient assessments are priced per assessment, with eligibility-based exemptions where they apply. Providers pay a service fee on completed services as set out in their agreement. Fees may be processed through third-party payment and eClaims providers, and taxes apply where required by law.
8. Intellectual property
CareChain, including the platform, its software, decision-support tools, branding, and content, is owned by CareChain or its licensors and is protected by intellectual-property law. You are granted a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You may not copy, modify, reverse-engineer, or create derivative works from the platform except as permitted by law.
9. Disclaimers and limitation of liability
CareChain is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CareChain disclaims implied warranties and is not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for personal injury caused by negligence. Clinical decisions remain the responsibility of the treating provider.
10. Changes and contact
We may update these terms from time to time. When we make a material change, we will update the date above and, where appropriate, notify account holders. Continued use after a change means you accept the updated terms. Questions about these terms can be sent to legal@carechain.ca.
